Naseem Al-Safwa Medical Supplies Store is an online store for the sale of medical supplies and products offered and available for purchase through the store, under the terms outlined in the terms and conditions document. First: Definitions
In this agreement, unless the context requires otherwise, the following terms have the meanings indicated:

- "Customer" refers to any person, entity, or company that places an order to purchase the products offered for sale through the store.
- "Products" refers to the products offered for sale on the website, including healthcare products and their accessories, and other products available through the store.

- "Agreement" refers to the terms and conditions, privacy policy, sales agreement, all main and subsidiary store pages, service descriptions, all information and content of services, all instructions, and special agreements made between the store on one hand and any of the store users on the other hand, as well as contracts related to the terms and conditions.
- "Parties to the Agreement" refer to the store as the first party in the contractual relationship, and any person who visits the store uses it, registers an account with the store, provides any of the store services, or benefits from our services in any form as the second party in the contractual relationship.
Second: Legal Scope of Our Services
(1) The website operates as an online store for the sale of products available through it, serving as our marketing tool where we present to the customer all information about the products offered for sale, including their specifications, based on which purchases are accepted. The presentation and advertisement of products available through the website constitute an "invitation to treat" and not a "binding offer." The contract is concluded with the customer when they submit a purchase request, and we accept this request based on the availability of the "Products" for purchase.
(2) The store is dedicated to selling products available through it, and our responsibility is limited to providing those products online, under the policies stated in the terms and conditions and the sales agreement. We offer all our services under the e-commerce system and its executive regulations applicable in the Kingdom of Saudi Arabia.
(3) Naseem Al-Safwa Store does not act as a provider of informational content, and the store does not consider itself a publisher of any content published through the store or any communication feature available on the store.
(4) You acknowledge and agree to exempt Naseem Al-Safwa Store from any liability arising from third parties.
Third: Legal Nature of the Agreement
(1) This agreement constitutes the complete and final agreement between Naseem Al-Safwa Store on one hand and any person who visits the store, uses it, or utilizes any of its features or functionalities on the other hand.
(2) This agreement is a valid contract with complete legal conditions and clauses, effective against all mentioned parties. Its provisions and obligations are binding on all parties, and none of them may disclaim or terminate it as long as it produces its legal effects.
(3) All parties acknowledge that this agreement constitutes the entire agreement between them, and they agree that they have not relied on any assurances, whether oral or written, in agreeing to this agreement, contrary to the provisions stated in it.
(4) The service descriptions and subsidiary pages of the store prepared by Naseem Al-Safwa Store are an integral part of this agreement.
(5) The sales agreement and any supplementary contracts to this agreement are an integral part of it, subject to the same terms and conditions as this agreement. They are interconnected in a manner that cannot be separated, both in existence and non-existence.
(6) Amendments to this agreement have the same legal effect and impact as this agreement.
Fourth: Consent and Legal Capacity
You acknowledge that you have the necessary legal capacity to enter into and consent to this agreement and that you have full and unrestricted legal authority under the following conditions:
(1) Eligibility and Consent for Natural Persons
- A user of Naseem Al-Safwa Store must be 18 years of age or older.
- A user of Naseem Al-Safwa Store must possess the legal capacity necessary to enter into contracts, and we are not responsible for verifying the eligibility of any website users.
- By using the services of Naseem Al-Safwa Store, you agree to this agreement and acknowledge that you are legally bound by the terms and conditions outlined in this document or its amendments.
(2) Eligibility and Consent for Minors (Those under 18 years old)

(5) Users undertake to promptly notify the store in case of any account breach, theft, or discovery of any unauthorized use of their store account so that necessary technical measures can be taken to secure the account.
(6) Users are not allowed to use another person's account at any time without explicit approval from Naseem Al-Safwa Store.
(7) We reserve the right to cancel unconfirmed or inactive accounts for an extended period.

Sixth: Digital Signature

(16) The services of the store are available within the Kingdom of Saudi Arabia. Therefore, we are not obligated to fulfill any orders in any other country. However, you can access the store from anywhere in the world.
(17) All rights not expressly granted to you in these terms of use or any other service terms are reserved by Naseem Al-Safwa Store, and the licenses granted by us will terminate if you do not comply with these terms of use or any other service terms.
(18) The customer is committed to accurately specifying the product to be purchased, according to the specifications they desire and available through the store, before placing the purchase order. The customer can purchase the products offered for sale through the store if these products are available and ready for sale. The customer is committed to paying the announced price for the product through the store, using the methods specified by the store.
(19) We may request additional verification processes from you at any time, including the customer's full name, national ID number, detailed address, phone number, and other information that we may deem necessary to complete the shipping process.
(20) The customer is obligated to comply with all policies followed by the store, including payment, shipping, return, and product use policies.
(21) The customer must comply with all provisions of the applicable laws, decrees, and regulations.
Eighth: Warranties
Naseem Al-Safwa Store is committed to providing all legal commitments and warranties to the customer, under the legal provisions applicable in the Kingdom of Saudi Arabia, as follows:
(1) The store guarantees its ownership of all legal rights and authorities to sell the products, ensuring that it has obtained all necessary permits for product sales.
(2) The store undertakes to clearly announce the prices of products through the store and to record these prices on the products when delivered to the customer. The customer has the right to request an invoice for the products purchased from the store.
(3) The store guarantees that all information, images, and files related to the products it offers on the store are accurate, truthful, and legal, representing the store's products.
(4) The store guarantees not to publish any false or misleading information about its products, ensuring that the presentation of the products adheres to commercial legitimacy.
(5) The store undertakes to make maximum efforts to obtain warranties from product manufacturing companies, if available. However, the store relinquishes these warranties to the customer to the extent permitted under this agreement.
(6) The store commits to delivering the products to the customer at the agreed-upon delivery time, as specified in the sales page, and ensuring that the delivery is done professionally by the terms of this agreement.
Ninth: Content Policy
(1) The store retains ownership of the content related to products, including all images and visual files, and holds the copyright to them at all times.
(2) The user acknowledges having full rights to publish content through the store, ensuring that this content does not violate any third-party rights.
(3) Users bear all legal responsibilities in case of violating any personal or intellectual property rights regarding the content they publish through the store.
(4) You agree not to send any messages characterized by racial discrimination, containing insults, offensive language, explicit images, or generally considered "in bad taste."
(5) You are not authorized to publish any links to other websites or applications through the store or any available features within the store.
(6) The store is not responsible for content publication, and we are not liable for any user violating the rights of others, as it is the sole responsibility of the user.
(8) The store is not responsible for the misuse of content, and the user who misuses the content is solely responsible. In such cases, the user is accountable to us for the use of store content.
(9) The store has the right to delete content posted by users through the store at any time if we find that the content violates intellectual property rights, trademarks, privacy rights, commercial rights, or any other proprietary rights of others.
(10) You acknowledge that the content posted on this store is for informational purposes only. The opinions and comments posted on the store are the views of the individuals publishing the content and may not reflect our opinions.
Tenth: Fees and Taxes
(1) The store does not impose fees for membership registration. Naseem Al-Safwa Store provides free membership to its customers.
(2) The store only collects the cost of the products from customers and does not impose any additional fees or costs except for shipping costs and cash payment fees.
(3) The products obtained by the customer from the store include all applicable government taxes. Value Added Tax (VAT) at a rate of 5% of the invoice value is added to the customer's invoice. The store collects it from the customer and then pays it to the tax authorities.
(4) In the case of using electronic payment for the products' cost, the bank used by the customer in the payment process may impose fees on money transfers. Therefore, the customer bears these fees.
Eleventh: Reviews Policy
The store provides a review and comment service for customers after each purchase, to offer better service to all our customers. The following conditions apply to adding comments:
(1) Comments must be honest, legal, and reflective of the service provided to the customer.
(2) The use of illegal words, phrases, or expressions during the review process is prohibited.
(3) Using logos, names of other websites or applications, and famous or non-famous trademarks during the review process is prohibited.
(4) Making comparisons between our services and those of our competitors that may harm us or the competitors is prohibited.
(5) Insulting nations, countries, cultures, societies, or any human, social, or religious values during the review process is prohibited.
(6) Posting any advertisements or promoting goods or services through our store's review service is prohibited.
(7) The store reserves the right not to publish comments if they are illegal or dishonest from our perspective.
(8) The store reserves the right to delete any comments that violate the above provisions or any of the terms and conditions, sales agreement, or privacy policy.
(9) The store reserves its legal right to resort to the judiciary in case of harm through the comments service.
(10) Other parties, who have been harmed through the comments service, have the right to pursue legal action against the customer who added illegal comments without referring to us.
Twelfth: Copyrights
(1) The store and the ideas expressed within it are exclusive intellectual property rights to us. Any imitation or quoting of the store or some of its services (including ideas, texts, symbols, and software) constitutes a violation of our copyrights, and we will take all legal actions against violators.
(2) All content included or available within the services of Naseem Al-Safwa Store, such as (texts, logos, images, graphics, audio recordings, button icons, digital content, reloaded materials, software, and data compilations) is the property of Naseem Al-Safwa Store and is protected by the laws of the Kingdom of Saudi Arabia and international copyright laws.
(3) Compiling all the data listed in Naseem Al-Safwa Store's service or provided by any of our services is the exclusive and private property of Naseem Al-Safwa Store. It is protected under Saudi Arabian and international copyright laws, as well as by applicable international agreements.
Thirteenth: Trademarks
(1) “نسيم الصفوة " or "NASEEM ALSAFWA" and associated logos are our trademarks and/or service marks.
(2) Images, logos, page headers, button icons, texts, and service names are trademarks and trade designs of Naseem Al-Safwa Store.
(3) Reproducing the trademarks or trade dress designs of Naseem Al-Safwa Store in any media or advertisement is prohibited without our written permission.
(4) The trademarks and trade dress designs of Naseem Al-Safwa Store may not be used in connection with any product or service that is not affiliated with us, so as not to diminish the stature and credibility of Naseem Al-Safwa Store or its customers.
Fourteenth: Legal Responsibility
(1) You must comply with all applicable laws and regulations in the country where you use the store, regarding your use of the store, and bear all responsibilities arising if you violate these laws or regulations. You also commit to all the terms and conditions specified in this agreement.
(2) In case the user violates any of the terms or conditions of this agreement, Naseem Al-Safwa Store has the right to take administrative action within the store, including suspending the membership for some time or imposing a permanent ban on the violating user. In such a case, the user is not allowed to register on the store again without explicit approval from Naseem Al-Safwa Store.
(3) The penalties imposed by Naseem Al-Safwa Store under this agreement shall not prevent any party to this agreement from taking any legal action they deem appropriate in their judgment, without referring to us in any form and without any responsibility on the store.
(4) The customer is asked under this agreement and the law and commits to compensate us in the event of placing fake or non-serious purchase orders to annoy us or waste our time. The customer is also legally responsible to shipping companies in such cases.
(5) If you violate this agreement, Naseem Al-Safwa Store reserves the right to demand any amounts due from you and claim compensation for any losses or damages caused. The store also has the right to take legal action or resort to competent courts to file civil or criminal lawsuits against you.
(6) Naseem Al-Safwa Store does not guarantee taking action against all violations that may occur to this user agreement, and the fact that we do not take legal action in any of these violation cases does not mean a waiver of our right to take these actions at any time we see fit.
Fifteenth: Our Limitation of Liability
(1) You explicitly agree that you use Naseem Al-Safwa Store at your own risk.
(2) We provide our services "as is," without any representations or warranties of any kind, whether express or implied, concerning the use of this store, its content, or the services provided on it.
(3) Online sales are subject to the availability of products at the store. Therefore, the customer exempts the store from any responsibility in case the products are not available or the quantity is depleted.
(4) The store does not guarantee the repair of technical defects, nor that the store's website or servers are free of viruses or any other harmful or destructive elements. You acknowledge that websites on the internet are always susceptible to data corruption, unavailability, or delayed appearance, and you accept that.
(5) The store may be unavailable from time to time due to maintenance, repair, or development activities, and you agree that the store is not obligated to provide technical support at all times.
(6) You acknowledge that Naseem Al-Safwa Store is an online-based service, and despite our best efforts to keep information secure, we cannot guarantee that the information received or transmitted during the use of the store is secure at all times.
(7) The store does not provide any warranty and assumes no responsibility regarding the timeliness, prevalence, accuracy, or quality of the information received or accessed through the store.
(8) The responsibility for using the information received or accessed through Naseem Al-Safwa Store or relying on it lies entirely with the user.
(9) Naseem Al-Safwa Store does not provide any guarantees regarding the absence of viruses or other harmful components from this store, its servers, or the messages sent.
(10) Naseem Al-Safwa Store cannot confirm that every user of the store is indeed the person they claim to be.
(11) The store will not be responsible under any circumstances for any direct or indirect loss, consequential loss, loss of profits or reputation, or any damage whatsoever resulting from the disclosure of your username and/or password.
(12) Naseem Al-Safwa Store, including its managers, partners, and all its employees, is not legally responsible for any losses or damages of any kind, whether direct or indirect, that may arise from the use of this store.
(13) We may, at any time, modify, suspend, or discontinue Naseem Al-Safwa Store services without notifying you. We may also terminate your use of our services if you violate these terms and conditions or if you misuse these services in our view.
(14) Naseem Al-Safwa Store reserves the right to suspend or cancel your membership or access to the store at any time and without notice and for any reason, without specifying, and it can terminate this user agreement without prejudice to its other rights.
(15) The product images, specifications, and all site content are for commercial purposes only. The content is not intended to be a substitute for medical advice, diagnosis, or treatment. For medical advice, please consult with a qualified healthcare professional or any authorized healthcare provider if you have any questions regarding a medical condition.
(16) Naseem Al-Safwa Store and the employees of Naseem Al-Safwa are not responsible under any circumstances for any direct or indirect damages that occur due to the use or inability to use any of the products purchased from the store.
Sixteenth: Compensation
(1) You agree to indemnify Naseem Al-Safwa Store, release it from liability, and defend it against all claims and demands that may be raised or demanded by others as a result of your use of the store or due to your violation of these terms and conditions, or any infringement of the rights of other users.
(2) The store excludes from its warranties, terms, and conditions any financial losses incurred by the customer, damage to reputation, or any special damages arising from your misuse of the products or the store, and the store is not responsible for any liabilities or claims in such cases.
(3) Naseem Al-Safwa Store, its officials, and employees will not be legally responsible to you or any other party for any direct or indirect loss or for any other costs that may arise from or in connection with the execution of the user agreement or in connection with the provision of our services.
(4) The user must protect Naseem Al-Safwa Store and its employees, defend them, and compensate them for any losses resulting from any claims or demands related to the store, or arising from the user's act or negligence, or that of their representatives or agents.
(5) You are obligated to compensate for any losses or damages that may be incurred by the store as a result of any unauthorized or unauthorized use by you.
Seventeenth: Amendments
(1) The user agrees to abide by any changes and modifications made by the store in the applied policies and is required to accept any modifications deemed necessary by Naseem Al-Safwa Store.
(2) We may, at any time, make any modifications or improvements we deem necessary to the store to enhance its effectiveness, and the user is committed to any guidelines or instructions provided by the store in this regard.

(5) You agree to comply with all additional terms and conditions that will be made available to you, related to the use of any of the services available through the store, and these additional terms and conditions are integrated into this agreement.
Eighteenth: Termination of the Agreement
The agreement is considered terminated automatically, without the need for excuses or legal proceedings, in any of the following cases:
(1) In the event of proven violation of any paragraph or clause of the terms of this agreement above, while preserving all our rights to claim compensation for the resulting damages.
(2) Abandonment or subleasing of the account without our consent.
(3) The user's failure to fulfill any obligations stipulated in this agreement, without taking serious actions to rectify this breach, while retaining our right to claim compensation if applicable.
(4) Failure to authenticate any information provided by you.
(5) If we decide at any time that your activities may cause legal disputes for you or other users.
(6) Suspension of store activities or the cessation of activities by those responsible for managing the store.
Nineteenth: Communications
(1) You agree to receive communications from us, and we will communicate with you via email, mobile number, notifications on the store, or through other services of Naseem Al-Safwa Store.
(2) You agree that all agreements, notices, disclosures, and other communications provided to you electronically meet all legal requirements as if they were written, and they have legal effects.
(3) During the registration process, Naseem Al-Safwa Store requests your consent to send messages to your email or mobile phone through the store for promotional purposes, to inform you of any changes, features, or new activities added to the store.
(4) If you decide at any time that you do not wish to receive promotional messages, you can disable receiving these messages by contacting us or withdrawing your consent to receive messages through the "My Account" page available on the website. In this case, we do not guarantee your full enjoyment of our services.
Twentieth: Notifications
(1) Any notifications intended for Naseem Al-Safwa Store must be sent through the specified means within the store, and any notifications sent outside the store will not be considered.
(2) Any notifications that Naseem Al-Safwa Store intends to send to you will either be announced on the store or sent to you via the mobile number or email you provided during the registration process. Your awareness of the notification is assumed upon announcement on the store or within 24 hours of sending the message to you.
Twenty-One: Transfer of Rights and Obligations

All parties are committed to fulfilling their obligations under this agreement before the transfer, and the transferee has the right to take all legal actions against any party that fails to fulfill its obligations under this agreement.
(2) You are not allowed to assign your obligations and rights under this agreement or pledge to manage your store account to a third party without obtaining written consent from us.
Twenty-Two: Applicable Law and Competent Courts
(1) This agreement is governed by the laws in force within the Kingdom of Saudi Arabia.
(2) The courts within the Kingdom of Saudi Arabia have jurisdiction over any dispute that may arise regarding the interpretation or implementation of the provisions of this agreement.
(3) If any provision of this agreement becomes invalid, illegal, or unenforceable, the legality and enforceability of the other provisions shall not be affected in any way by that provision.
Twenty-Three: Language
(1) The Arabic text of this agreement is considered the official text to interpret and apply its terms and provisions.
(2) In case of any conflict between the Arabic text and the translated text of this agreement, it is agreed that the provisions in the Arabic language shall prevail in such a case.
